The 2019 Fraud Update will be presented by Pat Fitzsimmons and Jessica Copeland of Hodgson Russ.

Fraud and Cybersecurity: A Lawyer’s Perspective

  • Representing clients who may have been victimized by embezzlement or fraud, representing clients accused of fraud, and how engaging an accountant under a Kovel arrangement can provide meaningful assistance to the client and counsel in either circumstance.
  • How a company can best protect the personal information of its employees and customers, through internal controls and external security protocols. Jessica will also provide tips and strategies for handling a cyber-incident or breach, including when to involve counsel and engage forensic teams; whether a PR firm is necessary depending on the line of business (if it is customer facing) and how to manage reporting requirements throughout the United States.


JESSICA L. COPELAND: Partner, Blockchain & Cryptocurrency Practice Co-Leader

Jessica effectively represents her clients in all aspects of business counsel and disputes, with a particular focus on data security, privacy and intellectual property. Jessica is also co-leader of the firm's Blockchain & Cryptocurrency practice.

Particular to her IP litigation experience, Jessica’s practice includes protecting patents and trademarks in federal and appellate courts and before the International Trade Commission for clients in industries such as medical and mechanical devices, computer software and hardware, pharmaceuticals, telecommunications, and e-commerce technologies. Jessica’s experience in appellate work includes argument before the Federal Circuit.

Jessica’s broad experience includes advising clients on data privacy compliance, incident response strategies, and breach notification requirements. She also has experience handling the transactional aspects of intellectual property, including drafting and negotiating licenses, preparing and prosecuting trademark applications, preparing opinions, and conducting due diligence investigations.

Additionally, Jessica is a veteran litigator with extensive trial and appellate advocacy experience, in both state and federal court. Prior to joining Hodgson Russ, Jessica practiced in the New York City office of a prominent intellectual property law firm, Morgan & Finnegan, LLP, Locke Lord, and she was a judicial intern for Judge Leonard D. Wexler in the U.S. District Court for the Eastern District of New York.


Patrick primarily concentrates his practice in the areas of white-collar criminal defense, business litigation, and False Claims Act matters. Prior to rejoining Hodgson Russ, Patrick was an assistant district attorney in the Erie County District Attorney’s Office where he gained extensive trial experience, both jury and non-jury, prosecuting a wide range of criminal matters. Patrick also has corporate and securities law experience, having worked in the corporate departments of both Hodgson Russ and Ropes & Gray LLP in its New York City office.
